   Indeed, the visit of the Pontiff to Australia for a World Youth Day provides a vehicle for his wry observation that if he had been Police Commissioner, " and some short Italian with a name starting with Rat, whose predecessors infamously used stand over tactics to make a huge fortune from tithing, landed his jumbo jet on my beat, then, surrounded by armed bodyguards, alighted wearing a dress and little red booties -- claiming to be JC’s representative on Earth -- I would immediately have him arrested, drug-tested and his plane searched for missing orphans."
   Extract from Chapter 11: The prosecutor was a Mr Lloyd Rayney from the office of the DPP. Now where have we heard that name before? Mr Rayney is now probably best known, rightly or wrongly, as the only person of interest in the murder of his wife, Corryn. Mr Rayney was so described by the Officer in Charge of the Police inquiry into the murder, one Detective Sergeant Jack Lee. Strangely enough, as matters often are in Perth investigative circles, the said officer then promptly took up a posting to a country Police Station to further his chances of promotion in the future. Good for him, of course, but not so good for Mr Rayney who is still left with Jack Lee’s tag but as yet uncharged.

   One instantly thinks of that infamous Assistant Commissioner of Police, Caporn, who had control of the inquiries into the Claremont serial killings only to tag and eventually name a public servant as the main suspect for over a decade only to be wrong again. This act caused untold harm to the reputation of the public servant and wreaked havoc on his and his family’s life.
   Then again, Mr Caporn did go on to redeem himself by getting an unfortunate indigent, Mr Andrew Mallard, sent down for the murder of a shopkeeper for 12 years hard before the real murderer was outed by someone else. It was whilst resting on his wonderful success in the Mallard conviction that Caporn led a decade long inquiry into the murder of numerous young women in the suburb of Claremont, once again unsolved as investigations concentrated on one suspect seemingly to the exclusion of others, as in Mallard, Button, Mickelberg, etcetera and so on.

A new Brian Burke biography is notable for not shedding any new light on Labor's shadowy ex-premier. Greg Craven reports.
Writing about the political phenomenon that is Brian Burke must be like wresting with a very large python.  Your subject is so vast, slippery and unpredictable that there are bound to be difficulties.
   So it is to Quentin Beresford's credit that The Godfather: The Life of Brian Burke is as good as it is. Though not without limitations, the book is thoroughly researched and well-written in its examination of one of Australia's most perplexing public figures.
   Beresford certainly captures Burke, the grimly determined son of the politically failed father. He convincingly traces Burke's iron will to succeed and to wield power to the appalling treatment of his loved father, Tom, by Labor's Left.
   He also plots a comprehensive atlas of Burke's legendary and undeniable charm, which allowed him not only to rise to power but then to reclaim it after seemingly terminal disgrace. This is important at a time when many Australians think of him only as a sinister and faintly bloated figure in a strange hat. As this book reminds us, it is Burke's capacity to collect people – as well as stamps – that has made him so lethal to friend and foe alike.
   Beresford also chillingly traces Burke's progress along a road that ultimately leads to a bleak and lonely place where power and its exercise are the only ends that matter. Whether Burke got there quite as quickly and comprehensively as Beresford suggests may be open to question, but the overall direction is difficult to dispute.
   The book is full of thoughtful insights into Burke's behaviour during the fraught years of WA Inc. As Beresford sketches the binding similarities of background and character between Burke, Laurie Connell and Alan Bond – all outsiders on the make – one begins to realise that there was more at play here than political and commercial forces.
   In fact, Beresford's total treatment of WA Inc. is compelling. Too often, this saga disappears into a maze of confusing commercial detail. Beresford's account is clear, lucid and compelling.
   The book, does, however have its difficulties. One is that Beresford is that unusual sort of biographer who does not like his subject, and it shows. The result is that the book is not only extremely unfavourable to Burke, but sometimes struggles to explain how such an apparently unlikeable man could have had the influence he did.
   This comes out in a variety of ways. One is that while Beresford comprehensively documents and demonstrates Burke's charm, he does it with such distaste that it is almost hard to accept his premise.
   Another is when Beresford describes some of the lobbying activities of Burke and his partner Julian Grill in tones of obvious outrage, but the reader finds themselves thinking "He's a lobbyist: What part of the word lobby do you not understand?"
   Finally, Beresford haughtily insists that just because Burke's second conviction was quashed on appeal, this did not necessarily establish his wider innocence. Obviously true, but so what? Being declared not guilty by a court is the only criterion of legal innocence we have.
   Strangely, given the centrality of Burke to recent West Australian politics, the book gets rather less compelling as it approaches the present day, rather than the other way around. You are left with the nagging sense that something is missing in Beresford's treatment of Burke's most recent campaigns for power.
   Perhaps it is the fact Beresford does not really offer a convincing explanation as to how Burke was able to rise from the political grave after the mid-nineties. Yes, he had the remnants of a faction and, yes, he was charming, but even allowing for that this man should have been as dead as Julius Caesar. Perhaps there really was more to Burke's appeal than patter and patronage.
   This leads to probably the biggest flaw in the book: it is too Burke-centric. Blaming WA Inc, and Brian Burke himself, on the charm and ruthlessness of Burke is all too easy. What is it about WA as a society that allowed Burke to flourish in a way that no similar political phenomenon has flourished in another Australian State?
   Beresford makes a few stabs at an answer, blaming a supine media culture and the perennial temptation to run the State as a giant resources company. But there was more than this going on.
   Reading Beresford's book, you are constantly struck by the same names in the drama, everybody knowing each other, everyone in bed together in one way or another in that simultaneously delightful and claustrophobic embrace we know as Western Australia.
   Could it be that the very smallness of Perth's political and commercial elites and the shortness of its lines of political communication make it particularly susceptible to domination by one gigantic personality with a talent for marshalling loyalty?
   The other peculiarity of the book regarding Burke's "Second Coming" is Beresford's myopia towards parts of Labor politics swirling around his ultimate demise. Certainly, the Left's targeting of Burke had the effect of closing down his undesirable operations, but are we really to believe their campaign was an act of altruism untinged by considerations of power and tribal hatred? Hardly.
   The book certainly proves one thing. It reveals a Brian Burke who may yet produce a sequel.

       [AFTERMATH: The "Stitch" was banned for alleged defamation by court action, the sequel was published, appeal after appeal occurred, the ban was lifted, and years later, FINALLY, "The Establishment" in the judico-politico-legal system of the State of Western Australia admitted that the convictions were "unsafe."
       And the appeal courts, grudgingly, have been finding other "unsafe" verdicts, such as murders "pinned" on John Button, Darryl Beamish, and Andrew Mallard.  One of the Mickelbergs, released from prison, was flying an aeroplane which "ran out of fuel," fatally for him.
       The Webmaster is proud to say he tried to sell the "Stitch" while it was banned and afterwards, and attended the ceremony in a bookshop, Hay Street, Perth, at which it was officially "relaunched" after the ban ended.  One of the allegedly minor sideshow bit-part actors in the lawless destruction of Ray, Peter and Brian Mickelberg had later entered the place where laws can be changed, and is retiring from there in 2008!     If the Hat Fits, Wear It
       This book covers some aspects of the twistings and turnings of Western Australian politics.  The Labor Government and the Australian Labor Party are split with differences, factional hatreds and allegiances, personal favours, and private interests.  The Government should be junked, but the economy is so buoyant that kindergarten kiddies could manage it.
       But it is streets ahead of the Liberal and National Parties.
       The power behind the Labor throne is Jim McGinty, Premier and ex-journalist Alan Carpenter being a compromise.
       Chapters 4 and 5 are about how two prostitutes made a professional tour to Port Hedland, allegedly with an unofficial "permission" from some police, in spite of the police superintendent's express prohibitions of gambling and prostitution in the area.  The women tried to get a sporting club to hold a raffle, with one of them as the prize!
       Chapter 6, "The Fat Wallet Mob 'Flow Charts'" details the story of people involved in mining and other shares.  Some of the people are supposedly ex-bankrupts and ex-prisoners.
       In chapter 7 WA Attorney-General Jim McGinty is said to have been sent a copy of the previous book, by a contact of Mr Ray Mickelberg, one of the family that it is said had been wrongly convicted over the Perth Mint Swindle.
       Mr McGinty allegedly returned the book in a plain envelope.  Requests for a response finally were rewarded.
       The chapter exposes alleged police false evidence in the case of a failed attempt to blow up the office where military conscription records were kept in Perth decades ago.
       The author praises Brian Burke and Julian Grill for lobbying to stop the gigantic firm Xstrata from leaving vanadium in the ground in recent years.  Parliamentarian John Bowler acted to save it, but was banished to the back bench in a hypocritical move, though he had saved the WA taxpayer from losing the value to the people of the $32 million spent for this mine.
    THE CHRISTIAN BROTHERS' ORPHANAGES
       Read about a dodgy internet website, Croatia, Laurie Connell's failed investment bank Rothwell's, a Malaysian Sting, and why Scaley hanged himself at a Christian Brothers' orphanage.
       Then there's the story of Tommy Trantrum being sent from Clontarf Boys' Town, freeing him from a paedophile Christian Brother, to a farm where he shot the farmer's wife and as a result went to prison.
       Then follows page after page about the four Christian Brothers' orphanages in WA – Clontarf, Castledare (both in Perth), Bindoon, and Tardun.
       Fifteen Brothers allegedly either had sex or quasi-sex, and/or gave cruel beltings to a boy called Fred Smith.  Urinating on him and bare-bottom beltings are described, with the names of the paedophile-sadistic offenders.
       The exposé of the Christian Brothers by Barry Coldrey, and the campaigning and publications of the late Bruce Blyth are covered.
    McGINTY, McVEIGH, McMAHON
       Jim McGinty had spent time at a Roman Catholic seminary.  His sister Susan became a nun.  Father Anthony McMahon was sent to Kwinana parish.
       "Now, Jim is a cousin of mine but it could not be alleged that we are close.  No, not close at all." (p 130)
       Leo McVeigh at the age of five was being babysat by the priest and the nun, and while with the priest only was allegedly sexually abused.  (The priest and the nun fell in love and married.)  He told Church authorities in 1998.  He tried to get the police's sexual abuse unit to investigate, but it didn't.  The author thinks that the relationship with highflyers is why no apology was made, nor justice served.
       "Holy Double Cross" is the story of the widow Mrs Catherine Musk who in 1947 left £47,000 in trust (worth millions now) so that suitable Bindoon boys would be helped to be set up on their own farms. (p 157)  None of the money went to the boys. The Church went to court to ask it to allow the balance, $167,000 in 2006, to be used for scholarships for deserving students to attend at Bindoon a commercial agricultural college – run by the Brothers.  Paying themselves again.  See Gary Adshead's report, The West Australian, January 24, 2006.        Senator Andrew Murray (retired June 30, 2008) tried to help justice.
       On page 174 the author writes "Mr Kucera had made a habit of falsifying witness statements.  Way back in 1972 … Mr Kucera … had a confession from Ripley.  The similarity between the fabrications in the Mickelberg case … Ripley unjustly got 5 years jail and Kucera a feather in his cap."

    BARRY, Paul; 2000 revision (orig 1990)   THE RISE AND FALL OF ALAN BOND  

         
       This book gives the story, up to the time it was written, of one of Australia's leading corporate rogues. The Rise and Fall of Alan Bond; Paul BARRY
       Using other people's money (as later insolvency and court proceedings showed), he even financed a challenge for the America's Cup, a near-land ocean race, and won with Australia II in 1983. (see p 6)
       He was a part, a large part, of "WA Incorporated," or the "Burke Years," along with Laurie Connell of Rothwell's "Bank," and others.
       Who was this man who had seemingly survived the stock market crash of October 1987 (p 1), bought Heileman's brewery for $1700 million (p 50, bought a Van Gogh painting "Irises" for US $49 million (p 4), and who had praised Chile's dictator Pinochet?
       According to this book, "He had plundered his public companies, crushed those little people who happened to get in his way, avoided paying taxes on a massive scale, and bent the rules at every opportunity … " and kept on borrowing and buying, borrowing and buying, until the banks finally called time. (pp 6-7)
       The book details his juvenile scallywag doings in Britain, and then goes on with his first Australian brush with the courts.
       According to The West Australian of June 12, 1956, "Alan Bond, 18, signwriter, of Quarry Street, Fremantle, appeared on two charges of having been unlawfully on premises. …
       "Bond was put on a £25 bond to be of good behaviour for six months on each of the two charges." (p 44)
       How did he get his real first million? There was a "huge block of already subdivided land at Kardinya, on Perth's southern edge, … up for sale at $1.2 million … he and McNab flew to Melbourne … went to the head office of a finance company called CAGA and borrowed the lot -- deposit and all. … The year was 1967, and Bond was twenty-nine.  He had made it at last.
       Yanchep Sun City (p 91), the failure to win the America's Cup with Southern Cross, then he returned to Australia.  It was 1974, and there was a vicious credit squeeze. (p 94)
       The cost of borrowing had soared above 20 per cent.  The developer Home Units of Australia had to be rescued, the bigger property and building company Mainline collapsed in August, and at the end of September the biggest of them all, Cambridge Credit, went to the wall. (p 94) The property boom which had raged so long had gone bust. (pp 94-95)
       Bond Corporation owed $100 million, and its assets would fetch only $50 million in a forced sale. (p 95)
       Banks had been lobbied by the Premier, Sir Charles Court. (p 99)
       Later the same Sir Charles criticised Bond (p 102), and rumours spread that Bond's group would collapse.  The Perth Stock Exchange commented on Bond's statement about his finances, and there was a penalty for spreading false information. (p 103)
       Finance companies had lent heavily for land, charging four per cent above what the banks did, fees were often 10 per cent of the loan.  But now CAGA let a deadline for interest be extended, and IAC which already had $80m of doubtful debts had the Bond $35m as well. (p 105)
       Because IAC was a company of Citibank (USA), US $140m was brought to prop it up, thus allowing Bond and others to continue.
       There had to be a rescue in February 1975 over the Robe River $2/2m interest payment.
       More crises were staved off, then Sir Charles Court's Liberal-National WA Government bought the Santa Maria estate "to safeguard Perth's water supply", and 15,000 acres (6070 hectares) on the southern edge of Yanchep, at a handsome profit to Bond. (p 120)
       Among the photographs is a picture of the Curtin Foundation, including PM Bob Hawke, Premier Brian Burke, Alan Bond, John Roberts of Multiplex, Cr Rod Evans, WADC chairman John Horgan, and Laurie Connell (Rothwells "Bank").
       The South Australian Parliament passed a special law to force Bond to reduce his holding in Santos from about 30% to no more than 15%.  He was able to sell shares on the stock market, where the shares had nearly trebled in value. (p 140)   He had made millions.
       Buying the Palace Hotel, Perth, gave the four principal directors a personal profit of $899,000 each.        [COMMENT: The financial trickery of the huge International Corporations and Banks is interspersed with the interesting facts about the 1970s and 1980s in Western Australia.  The "recovery" from those rollercoaster days allowed the global credit system to survive, with even more unrealistic schemes and unrealistic huge credit creation, until the whole world's system began staggering around 2007-2008.  All sorts of leaders in various countries kept saying that the fundamentals of their particular country "were sound," but by October-November 2008 it was like whistling in the wind.
       By February-April 2009 it is obvious that the Global Corporations are running a Great Recession, or even the start of another Great Depression.  Huge insurance companies, banks, and great vehicle manufacturers are asking governments around the world to save them from collapse.  Governments make no provision to stop job-shedding, but lend or grant billions to the Top End of Town.  The taxpayers will later have to repay the bonds that were sold to get funds that saved the banks!  It is a "round robin" fraud of global proportions!

       The secondary title of this 44-page booklet is "An audit and history of State powers and responsibilities usurped by the Commonwealth in the years since Federation," and it is dated February 1994.
       The federal constitution came into force in 1901, leaving the States in sole responsibility for governing regarding everything except powers explicitly stated as given to the federal Commonwealth.
       These sole State powers included: Law and order, the regulation of commerce and industry, transport services, natural resources including land, essential service such as water supply, sewerage, drainage, electricity and gas; local government; education, housing and health; and the environment. (p 7)
       Since federation, the Commonwealth had intruded into every one of these sole responsibilities, the booklet states, in some cases to effectively usurp the States' role for all practical purposes. (p 7)
       The downward spiral towards centralism lists the loss of income tax, which the Commonwealth took over exclusive rights to in 1942, under wartime regulations.
       Mr Court rightly points out that the High Court of Australia has wrongly taken powers and responsibilities from the States.
       (It is now clear to this reviewer, at least, that before federation the Colonies ought to have insisted that they appoint, in rotation, the judges to the High Court.)
       The 1975 Racial Discrimination Act, the 1988 Franklin Dam case, the 1992 Mabo cases, and the 1993 Commonwealth Industrial Relations Reform Act were among the losses of State powers that were listed.  Some had worthy intentions, but the aggregate loss of powers can lead to a centralised out-of-touch oligarchy.
       Examples of Commonwealth intrusion, that most electors would not know about, were the 1920 decision in the Amalgamated Society of Engineers case, the Petrol Tax case stopping South Australia from levying petrol tax, and the John Fairfax and Sons Ltd case to stop New South Wales from levying a tax on newspapers.
       One of the inexplicable High Court decisions was the 1985 Gosford Meats case, disallowing the NSW Government from levying an annual licence fee on an abattoir, claiming it was an excise duty (and so invalid under Section 90). (p 30)

       Precis: 18 November 1987, Mr MacKinnon asked the Treasurer how much had been approved for the State Government Insurance Corporation (SGIC) to borrow to buy property and shares from the Bell Group.  Mr Brian Burke replied that no decisions had been made.  On 13 November the SGIC Board noted that the deal would require the Premier to approve borrowing of $160 million.  On 19 November the Board was told that the Premier had approved. … An enquiry draft stated "The conspiracy to retrieve the monies by administrative abuse of Government instrumentalities such as the SGIC, GESB and the R & I Bank becomes crystal clear."        Besides the women and men he murdered and injured, Eric Edgar Cooke's rampage also was partly to blame for two innocent men, John Button and Darryl Beamish (a deaf-mute) going to prison for murders they did not commit. Broken Lives, Estelle BLACKBURN
       How the police got confessions from Cooke, and then got him to issue retractions, is one of the amazing parts of this wonderful book by Estelle Blackburn, BA, journalist and later public relations officer.
       Some of the detectives and others involved ought to have been charged with something, and punished themselves, because it was obvious that John Button was innocent.
       The John Button miscarriage of justice was just one such by the Western Australian police force and the courts in the 20th century.
       Eric Edgar Cooke, who had a hare lip and a speech impediment, was 17½ years old on October 15, 1948, in the first stealing incident recorded in this book.  He stole a torch and a travelling clock, total value £3/13/- from a city flat occupied by John Birman, the assistant director of Adult Education. (p 26)
       The book goes on, detailing his accidents at work, his marriage and subsequent children, his night-time prowling and stealing of small moneys etc and of cars and deliberately running people down (starting in 1958, p 46), his regular cat burglar exploits, and then his murder of women.
       He stole first one rifle, and later another, using them to shoot men and women, either in their cars or at home or in bed (Jillian Brewer, p 88).  He had spent some time in prison for some of his minor crimes.
       Yet he was not even really suspected of the major killing spree, which had Perth in fear in the early 1960s, until a woman picking bush flowers stumbled across where he had stashed the second rifle.
       The book gives details of how the lives he had broken, including the families and the surviving victims, and his own wife and children, continued afterwards.
       Some of the blame must fall on his father, who had hated him from birth and had belted him repeatedly.
       Cooke was the last man hanged legally in Western Australia; it was on Monday, October 26, 1964.

       AUSTRALIA: I first met David on September 10, 1996. He was 37 years old, tall, slender with dark hair and kept himself well groomed. I came to learn that he spent more time in the bathroom than any woman I know, including me. It was a common complaint from my daughter: If she didn't get to use the bathroom first on the mornings he stayed at my home, she would be late for the school bus.
       A few days after meeting David at the La Grange Hotel, he called me to say he would like to catch up with me for dinner some time. It was the end of the parliamentary sitting week and I was heading back to Queensland. We agreed we would meet during the next sitting session.
       During the next parliamentary sitting in Canberra he contacted me again wanting to catch up and have a bite to eat. He said he was concerned about being seen in public with me and asked if we could go somewhere private to talk and have dinner. It was very hard in Canberra because I had already become well known. I suggested that we have dinner in my unit at the Sundowner Village Motel which had its own cooking facilities. David not only arrived with the food and a bottle of wine but he also prepared it.
       We enjoyed each other's company and talked for hours. Not only did we talk but we ended up spending the night together. It was dawn before he left my unit.
       It was not until that night that he revealed he was associated with the Liberal Party and was a staff member for Tony Abbott, MP for the NSW seat of Warringah, and was on the Manly Council in Sydney. He stressed that it was very important his identity and association with me not be disclosed to anyone.
       My personal relationship with David did not last and was over in a couple of weeks. I knew he was not a man I could have a long-term relationship or fall in love with. I will always believe David used our short but close relationship to get a foot in the door. #

       Phil Burrows became the innocent victim of an anonymous phone call, suggesting he had pornographic materials at his home. A search of his flat found a series of photos taken in the course of his studies into children's playground rhymes. On the basis of one of these photos, he was charged with 3 counts of indecent dealing.
       His life was turned into a living nightmare. This remarkable story tells of the acts of malice, as well as mistakes, that can have tragic consequences. Above all, it shows how frail our rights and liberties really are.
    The Author
       Phil Burrows is 48 years of age and has been teaching for 27 years of those years.
       A dedicated teacher, his career with the W.A. Education Department has included appointments from classroom teacher to Principal. His academic life has been relentless, involving over 10 years external studies and another 6 years part time, during which he completed a Master of Education degree.
       Phil has published extensively, both in his academic field of language and concerning Civil Liberties. He has served as Secretary of the W.A. Council for Civil Liberties and feels that issues of liberty and justice are of first importance.
